The
U.S. Department of Justice has filed a brief asking the Supreme Court to find a key section of the Defense of Marriage Act unconstitutional,
arguing the law violates the Constitution’s guarantee of equal
protection. DOMA’s section 3 prohibits the federal government from
recognizing legally married same-sex couples.
"It is abundantly clear
that this discrimination does not substantially advance an interest in
protecting marriage, or any other important interest," the DOJ brief
reads. The White House must decide this week if it will also submit a
brief in a pending case regarding California’s Proposition 8.
