HRC Calls on Former Gov. Jeb Bush to Explain Support for Anti-LGBT “Religious Freedom” Legislation

Yesterday, the Human Rights Campaign, the nation’s largest lesbian, gay, bisexual and transgender (LGBT) civil rights organization, called on former Governor Jeb Bush to clarify recent comments supporting new so-called “religious freedom” protections in states across the country that would put LGBT Americans and other minority groups at risk of discrimination.

At an appearance in Atlanta Thursday, Bush was asked about a deplorable bill that recently passed the Georgia State Senate that would allow people to use their religion to challenge or opt out of various laws—including local laws in Atlanta and other cities—that protect LGBT people and other minorities from discrimination in employment, housing, and public accommodations. That proposal would allow businesses to refuse service to same-sex couples, a paramedic to refuse to provide life-saving services to an LGBT person, or a school counselor to refuse services to an LGBT teenager.

Bush expressed support for new “protections” that would come from legislation like Georgia’s that would legalize discrimination under the guise of so-called religious liberty. Currently, there are 70 bills pending in 23 states that are considering dangerous religious refusal legislation like it.

“It’s deeply disappointing that Governor Bush won’t stand up against legislation that authorizes discrimination,” said JoDee Winterhof, HRC’s Vice President for Policy and Political Affairs. “We don’t need dangerous new legislation that not only allows discrimination against LGBT people, but goes even further and opens the door to allowing women and members of other religious faiths to be targeted and discriminated against as well. Governor Bush needs to clarify and explain why he thinks it’s acceptable to expose LGBT people and so many others to the risk of discrimination.”

The harm these bills may cause doesn’t end with the LGBT community. Under several proposed pieces of legislation—many of which are modeled on a failed attempt in Arizona last year that drew condemnation from businesses, faith communities, and elected officials in both parties—an evangelical police officer could feel empowered to refuse to patrol a Jewish street festival; a city clerk could shirk the law and refuse a marriage license to an interracial couple, a divorcee seeking to remarry, or a lesbian couple; an EMT could claim the law is on his side after refusing service to a dying transgender person in the street; and the enforcement of other key sections of civil rights law could be dramatically undermined. In many cases, these extreme bills will permit anyone to sue a government entity or business executing a government policy over their personal religious beliefs.

Such legislation would critically undermine the enforcement of state non-discrimination protections, and passing them will do serious harm to the business climate of these states—exposing small business owners to a wave of lawsuits, putting jobs at risk, and making major corporations think twice about investing in states that previously had pro-business reputations.

Log Cabin Republicans Demands Full Repeal of Death Tax

Log Cabin Republicans has sent a letter to House Ways and Means Committee Chairman Paul Ryan praising him for bringing forward H.R. 1105, the Death Tax Repeal Act of 2015, for committee markup Wednesday, March 25 and encouraging its full and swift passage in the House of Representatives.

In the letter, which can be read at this link, Log Cabin Republicans National Executive Director Gregory T. Angelo states, “The Supreme Court’s historic 2013 opinion in United States v. Windsor, which ruled that the federal government treat married same-sex couples in the same manner as their straight counterparts, was a case whose very predication was based on the inequalities inherent in the Death Tax. Regardless of sexual orientation, the Death Tax highlights the flaws in the tax code in which the federal government chooses winners and losers, and leaves families — many of whom merely seek to transfer or retain property rather than money — levied with disproportionate penalties in their moment of greatest vulnerability.”

The letter is also being sent to every member of the United States House of Representatives.

Presbyterians approve expanding definition of marriage

Leaders of the Presbyterian Church (U.S.A.) voted Tuesday to amend its constitution with a more inclusive definition of marriage. The vote means that the church now defines marriage as "two people, traditionally a man and a woman." 

Evan Wolfson, president of Freedom to Marry, said the change "is yet another powerful mainstream affirmation of America's movement to embrace the freedom to marry as a reflection of the morality of treating everyone as we all would want to be treated."

"Conversion therapy" ban advances in Iowa

The Iowa Senate passed a bill Tuesday that would ban mental health professionals from practicing LGBT "conversion therapy" on minors. The bill now heads to the Republican-led House.

Congress to consider Social Security benefits for same-sex couples

A bill aimed at ensuring all married same-sex couples in the U.S. are eligible for Social Security spousal benefits was introduced by Sen. Patty Murray (D-Wash.)in both chambers of Congress on Tuesday. Same-sex spouses now must live in a state that recognizes their marriage in order to receive benefits.

Lawmakers target campus bullying with Tyler Clementi Act

Lawmakers in the House and Senate this week introduced legislation aimed at ending harassment on college campuses. 

The Tyler Clementi Higher Education Anti-Harassment Act, named after a Rutgers University student who committed suicide in 2010, would require universities that receive federal funding to establish anti-harassment policies.
